1.1. Avail is a platform (mobile application) for posting and finding listings for goods and services across various categories.
1.2. By using the app you fully accept these Terms and the Privacy Policy. If you do not agree, please stop using the app.
1.3. Signing in with Apple or Google, registering by email, or any use of the app constitutes acceptance of these Terms.
2.1. The app may be used only by persons over 18 years of age.
2.2. You must provide accurate information at registration and in your profile and keep it up to date.
2.3. You are responsible for keeping access to your account secure and for all actions performed with it.
2.4. The platform may delete or block an account created in violation of these Terms (including a false age or re-registration after a ban).
3.1. Avail is an information platform connecting sellers and buyers. The platform is not a party to transactions, does not take part in settlements between users, and is not a seller, buyer, agent or guarantor.
3.2. The platform does not verify goods and services and does not guarantee their existence, quality, safety, legality or conformity with the description, nor the solvency or good faith of users.
3.3. All transactions are concluded directly between users, and all related disputes are resolved between the buyer and the seller without the platform's participation.
3.4. Safety recommendations (for example, do not prepay strangers, inspect the item in person) are for information only.
4.1. Basic posting of listings is free. Additional promotion services are paid (section 9).
4.2. A listing must be accurate, relate to a real product or service, and be placed in the appropriate category with a correct location.
4.3. Duplicate listings, false prices, use of other people's photos or texts without rights, offensive language and misleading information are prohibited.
4.4. By posting a listing you confirm that you are entitled to sell the item (provide the service) and hold the rights to all posted materials (photos, texts).
4.5. Prices are set by the seller in the currency of their choice. Automatic conversion into other currencies (including the "approx." line under the price) is for reference only: it uses periodically updated exchange rates and may differ from the rates of banks and exchange offices. All settlements under a transaction are made directly between the parties (section 3).
It is prohibited to post listings for: narcotic and psychotropic substances; weapons, ammunition and explosives; medicines and prescription drugs; alcohol, tobacco and vapes where restricted by law; escort and other intimate services; protected animal species and their derivatives; counterfeit goods; stolen property; documents, license plates and state awards; financial pyramids and "earning schemes"; any goods or services whose circulation is prohibited or restricted by the law of the country of posting. False and fraudulent listings are also prohibited.
6.1. When bulk-uploading listings (including photos from external links) you warrant that you hold the rights to all uploaded materials.
6.2. Materials may be processed automatically by the platform: AI-assisted recognition and structuring of text, cropping and compression of photos, geocoding of the address or district. The user is responsible for the content of uploaded listings.
7.1. By posting content (listings, photos, reviews, messages) you grant the platform a non-exclusive, royalty-free licence to store and process it (including automatic cropping, compression and translation), display it to other users and use it to promote the platform for as long as the content is posted.
7.2. The platform may remove any content violating these Terms or the law without prior notice.
8.1. Listings undergo moderation (including automated, AI-assisted moderation) before publication and may be re-checked after editing. The platform may reject or unpublish any listing.
8.2. Users can report a listing or another user and can block another user (blacklist) — a blocked user cannot message you.
8.3. For violations the platform may restrict account functionality, unpublish listings, suspend or delete the account. Paid services active on listings removed for violations are not compensated.
9.1. The app has an internal balance (credits). Credits are internal settlement units of the platform: they are not money or electronic money and cannot be withdrawn, exchanged or transferred.
9.2. The balance is topped up via Apple App Store / Google Play in-app purchases. Payment data is processed by Apple/Google; the platform never receives your card details.
9.3. Paid promotion services (for example bump, highlight, turbo) are deemed rendered at the moment of activation and are non-refundable, including if the listing is later removed, rejected by moderation through the user's fault, or the account is deleted.
9.4. Promotion increases the visibility of a listing but does not guarantee specific positions in search results, views, contacts or a sale.
9.5. The platform may change the range and prices of paid services. Changes do not affect services already paid for and activated.
9.6. Upon account deletion unused credits are forfeited without compensation.
10.1. A review may be left only about real interaction with a seller. Reviews reflect the personal opinion of their authors; the platform does not guarantee their accuracy.
10.2. Rating manipulation, reviews of transactions that never happened and insults in reviews are prohibited. Such reviews may be removed and offenders' accounts restricted.
10.3. Reviews are not removed merely because the seller disagrees with the rating.
11.1. Correspondence is stored on the platform's servers and is available to the participants.
11.2. The moderation team may access correspondence when handling reports and signs of violations.
11.3. Automatic message translation is performed by a third-party AI service and may contain inaccuracies; translations are for reference only.
11.4. Spam, insults, fraud and malicious links are prohibited in chats.
12.1. The app is provided "as is". The platform makes reasonable efforts to keep it running but does not guarantee error-free or uninterrupted operation.
12.2. The platform is not liable for users' actions, the content of listings, the outcome of transactions, or for indirect losses and lost profit.
13.1. The platform may amend these Terms. A new version takes effect upon publication in the app; material changes will be additionally announced in the app.
13.2. Continued use of the app after changes constitutes acceptance of the new version.
14.1. Before going to court, please send a claim to Ruslan-appstore@bk.ru; the response period is 30 days.
14.2. The law of the country of the platform operator's registration applies, unless mandatory rules of the user's country provide otherwise.
